On Wednesday, April 29, 2015, Governor Jay Inslee signed into law HB 1601. For far too long, Washington counties had contracted around existing Washington law that gave a contractor the choice to sue a county in either that county, or one of the two nearest counties. County construction contracts regularly took away this choice, requiring contractors to sue the county in the county’s home court. But the Governor’s signing of HB 1601 into law makes those county contract provisions unenforceable. This legislation helps provide an impartial forum for contractors and promotes fairness. NUCA of Washington spearheaded the significant work that led to the passage of this important legislation, receiving valuable support from the AGC of Washington and the Washington Construction Industry Council along the way.
